1. The service we provide

Access Funding Network is a free lead-generation and matching service. We connect business owners with independent, third-party funding providers in our network. We are not a lender, broker of record, or funding provider. We do not make credit decisions, set rates or terms, originate or fund advances or loans, or guarantee that you will be matched with a provider or that any provider will offer you funding.

2. Eligibility

You must be at least 18 years old, a resident of the United States, and authorized to act on behalf of the business for which you submit a request. By using the service, you represent and warrant that you meet these requirements.

3. Your information & consent to be contacted

You agree to provide accurate, current, and complete information. By submitting our form and checking the consent box, you provide your express written consent to be contacted by Access Funding Network and its funding and marketing partners as described in our Privacy Policy, including by automated calls, prerecorded messages, text messages, and emails. Consent is not a condition of any purchase. You may revoke consent as described in the Privacy Policy.

4. No professional advice; no offer of credit

The content on our website is provided for general informational purposes only and does not constitute financial, legal, tax, or other professional advice. Nothing on the website is an offer or commitment to lend or to provide funding. Any funding offer comes solely from a third-party funding provider and is subject to that provider’s terms and underwriting.

5. Relationship with funding providers

Funding providers in our network are independent third parties. We do not control and are not responsible for their products, rates, terms, decisions, conduct, or compliance. Any agreement you enter into with a funding provider is solely between you and that provider. You are responsible for reviewing and understanding the terms of any funding offer before accepting it.

6. Acceptable use

You agree not to use the website unlawfully, submit false information, impersonate others, interfere with the site’s operation, attempt to gain unauthorized access, or use automated means to access or scrape the site without our permission.

7. Intellectual property

The website and its content, including text, graphics, logos, and design, are owned by or licensed to us and are protected by intellectual property laws. You may not copy, reproduce, or create derivative works without our prior written permission.

8. Disclaimers & limitation of liability

The website and services are provided “as is” and “as available,” without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the site will be uninterrupted, error-free, or secure, or that you will be matched with a provider or receive funding.

To the fullest extent permitted by law, Access Funding Network and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising out of or related to your use of the website or services. Our total liability for any claim will not exceed one hundred U.S. dollars ($100).

9. Dispute resolution & arbitration

Please read this section carefully. Except where prohibited by law, you and Access Funding Network agree that any dispute arising out of or relating to these Terms or the services will be resolved by binding individual arbitration, and not in court, except that either party may bring an individual claim in small-claims court. You and Access Funding Network waive the right to a jury trial and the right to participate in a class action. You may opt out of this arbitration agreement by notifying us in writing within 30 days of first accepting these Terms.

10. Governing law

These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws principles, except that the Federal Arbitration Act governs the interpretation and enforcement of Section 9.

11. Indemnification

You agree to indemnify and hold harmless Access Funding Network and its affiliates, officers, and agents from any claims, damages, liabilities, and expenses arising out of your use of the website, your violation of these Terms, or your violation of any law or the rights of any third party.

12. Changes to these Terms or the service

We may modify these Terms or the website at any time. When we change these Terms, we will update the “Last updated” date above. Your continued use of the website after changes take effect constitutes acceptance of the revised Terms.
